Terms of Service

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your access to and use of PixCutly (including the KnoLz experience). PixCutly is operated by RD AINAN GLOBAL TECHNOLOGIES PRIVATE LIMITED ("PixCutly", "we", "us").

By accessing or using PixCutly websites and services (including pixcutly.com and related PixCutly experiences we operate), you agree to these Terms and our Privacy Policy. If you do not agree, do not use PixCutly.

2. Eligibility

You must be legally able to enter into these Terms. If you use PixCutly on behalf of an organisation, you represent that you have authority to bind that organisation. Where applicable law requires parent or guardian authorisation for a minor, that authorisation is required before use.

3. Description of the Platform

PixCutly is an AI-powered creative and content platform. Depending on what is enabled for your account and at the time of use, PixCutly may include:

  • Background Removal
  • AI image tools
  • PixCutly AI
  • AI Editor
  • Templates
  • AI Voice / text-to-speech
  • AI Video
  • AI BGM
  • AI Song / music generation
  • user uploads and generated outputs
  • account and profile features
  • Community
  • Affiliate program
  • AI Credits
  • paid Background Removal plans
  • digital downloads and exports

Not every feature is always available. Features, models, providers, limits, and interfaces may change, be suspended, limited, offered as beta or experimental, or discontinued. Avatar Video and Full Movie functionality, where shown, may be beta or experimental and is not promised as a guaranteed production service. Voice cloning is not currently offered as a live PixCutly feature.

Preview, hidden, or development-only experiences — including any unreleased website, domain, or professional-email related work — are not generally available products and are not guaranteed.

4. Accounts

Some features require an account. Authentication may use third-party services such as Supabase and Google sign-in.

You are responsible for:

  • keeping your login credentials secure
  • all activity under your account
  • providing accurate account information

Notify us promptly if you suspect unauthorised access.

5. User Content

"User Content" means material you submit to PixCutly, including prompts, text, uploaded images, videos, audio, voice material, likeness, trademarks, logos, copyrighted material, Community posts, messages, and other content.

You must have all rights and permissions needed to submit User Content and to authorise the processing described in these Terms.

You retain whatever rights you already have in User Content you own or control. PixCutly does not claim ownership of your original User Content solely because you uploaded it or because we processed it.

You grant PixCutly and its service providers only the limited rights reasonably necessary to process, host, transform, transmit, display, and deliver the services you request, and to maintain security, prevent abuse, and comply with law. This licence ends when User Content is no longer needed for those purposes, except for copies retained in backups, logs, billing or security records, or as otherwise described in the Privacy Policy or required by law.

6. AI Outputs

"Generated Content" means outputs produced in response to your requests, such as processed or generated images, audio, video, music, editor exports, or other creative results.

You understand that:

  • AI outputs may be inaccurate, incomplete, unexpected, or unsuitable
  • outputs may not be unique
  • similar outputs may be generated for other users
  • PixCutly does not guarantee copyrightability, exclusivity, or legal clearance of outputs
  • you must review outputs before relying on, publishing, or commercially using them

7. Commercial Use

Paid plan or feature outputs may be used for commercial purposes where the applicable PixCutly plan or feature expressly permits that use. That permission:

  • does not transfer rights that PixCutly does not own
  • does not guarantee copyrightability or exclusivity
  • remains subject to applicable law
  • remains subject to third-party, provider, and content licences, including licences for stock, fonts, models, and similar assets
  • requires you to possess all necessary rights in your inputs

PixCutly does not make an absolute, universal commercial-rights guarantee covering all outputs, inputs, or third-party materials.

8. Third-Party Stock Content

Third-party photos, videos, fonts, and other assets remain subject to the original provider or licensor terms. PixCutly does not transfer ownership of third-party content. Availability and licensing may change.

Users are responsible for complying with applicable restrictions, including issues involving identifiable persons, trademarks or logos, editorial content, standalone redistribution, and commercial use.

Examples of third-party content sources that may appear in PixCutly, depending on the feature, include Pexels, Pixabay, and Unsplash. PixCutly does not own those libraries.

9. Unsplash Content

Where Unsplash content is displayed or otherwise made available in PixCutly, that content remains subject to applicable Unsplash terms, licence, and attribution or provider requirements. PixCutly does not own Unsplash content and does not transfer Unsplash ownership to you.

10. AI Providers

AI features may rely on third-party providers and models, which may include Google Gemini-family, Veo, Lyria, or text-to-speech services, OpenAI, D-ID for experimental or beta avatar functionality where enabled, and other providers we use from time to time.

Availability, model behaviour, limits, and provider policies can change. Unless expressly offered in writing for a specific service, PixCutly does not provide a guaranteed service level.

11. Voice, Likeness, and Synthetic Media

You may not:

  • impersonate a person without authorisation
  • create deceptive or fraudulent content
  • use another person's voice or likeness without the rights and consent required by applicable law
  • violate publicity, privacy, or similar rights

For experimental or beta avatar functionality, you must have appropriate permission to use any likeness you submit or generate. PixCutly does not currently offer working voice cloning as a live product feature.

12. Prohibited Use

You must not use PixCutly to:

  • engage in illegal activity
  • commit fraud or deception
  • engage in harmful impersonation
  • submit unauthorised copyrighted content
  • violate privacy or publicity rights
  • use abusive automation that interferes with the service
  • bypass security, authentication, metering, or usage limits
  • use stolen or unauthorised payment methods
  • infringe intellectual property or other rights
  • distribute malware or otherwise abuse the platform
  • attempt unauthorised access, disruption, or reverse engineering

13. AI Credits

Certain features may quote and consume AI Credits. Credits may be held before processing. Successful operations may capture or settle held credits. Certain failed or pre-provider operations may release held credits back to your available balance.

A release of held credits is not a cash refund. Consumed credits are governed by the Refund & Cancellation Policy. PixCutly does not promise that every possible failure will result in a credit release.

14. Paid Services

PixCutly may offer paid Background Removal plans, AI Credit recharges, and other paid digital services. Applicable GST or other taxes may apply. Payments are processed through Razorpay.

Paid purchases, subscriptions, and Razorpay settlements currently remain associated with RD AINAN GLOBAL TECHNOLOGIES PRIVATE LIMITED pending a separate payment migration. Existing paid entitlements continue. A new payment gateway is not claimed as operational.

Prices, credit costs, and included features may change prospectively. Material terms applicable to a purchase will be presented before you complete that purchase.

15. Subscriptions

Where recurring subscriptions are offered, they renew according to the applicable billing terms shown at purchase until cancelled.

You may request cancellation through available account controls or, where a self-service control is unavailable, by contacting support@pixcutly.com. Cancellation is intended to stop future renewal according to the applicable billing terms. These Terms do not promise prorated refunds for an unused portion of a current billing period, except where required by applicable law or as described in the Refund & Cancellation Policy.

16. Affiliate Program

Affiliate participation and commissions may be subject to program rules, verification, anti-fraud measures, and changes. PixCutly does not guarantee any particular commission rate in these Terms.

17. Community

Community users must have the rights needed to publish or share content they submit. Community content remains subject to these Terms, applicable law, and any additional Community rules we publish.

18. Availability and Beta Features

Features may be beta or experimental. Continuous or uninterrupted availability is not guaranteed. Maintenance, outages, provider issues, and events beyond our control may affect the service.

19. Suspension

PixCutly may suspend or restrict access for abuse, fraud, security issues, legal reasons, or violation of these Terms.

20. Intellectual Property

PixCutly's software, interfaces, designs, website materials, and other platform materials used to operate the services are owned by or licensed to RD AINAN GLOBAL TECHNOLOGIES PRIVATE LIMITED and/or related rightsholders, and are protected by applicable law. Historical payment-related arrangements may still involve Ainan Signage Company as described in these Terms; that does not by itself transfer trademark ownership.

The PixCutly trademark application is currently in Navajit's individual name. These Terms do not claim exclusive company ownership of that trademark application in the absence of a recorded assignment. Branding, names, and logos used on the site may therefore be subject to rights held by the company, licensed rightsholders, and/or individual applicants as applicable.

These Terms do not transfer ownership of PixCutly platform materials or trademarks to you. Your licence to use the services under these Terms is unchanged by internal ownership or licensing arrangements among rightsholders.

21. Disclaimers

To the maximum extent permitted by law, PixCutly is provided "as is" and "as available." We disclaim warranties of merchantability, fitness for a particular purpose, non-infringement, uninterrupted operation, and accuracy of AI or image-processing outputs, except where such disclaimers are not allowed.

22. Limitation of Liability

To the maximum extent permitted by applicable law, RD AINAN GLOBAL TECHNOLOGIES PRIVATE LIMITED (and, for paid transaction matters still associated with RD AINAN GLOBAL TECHNOLOGIES PRIVATE LIMITED pending payment migration, that associated merchant) will not be liable for indirect, incidental, consequential, special, exemplary, or similar damages, or loss of profits, data, goodwill, or business opportunities, arising from your use of or inability to use PixCutly.

23. Indemnification

To the extent permitted by applicable law, you agree to be responsible for claims arising from your unlawful use of PixCutly, your User Content, your use of Generated Content, infringement of third-party rights, or violation of these Terms.

24. Privacy Policy

Our collection and use of personal information is described in the PixCutly Privacy Policy. By using PixCutly, you also acknowledge that policy.

25. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date will reflect revisions. Continued use after changes are posted means you accept the updated Terms.

26. Governing Law

These Terms are governed by the applicable laws of India.
